These FunderPro General Terms of Use (the “General Terms”) govern your access to and use of the website available at www.funderpro.com (the “Website”) and the Company’s client portal/dashboard (the “Dashboard”), including any general features, content, communications and support channels made available by FunderPro.
By creating an account, accessing or using the Website or Dashboard, or otherwise indicating acceptance of these General Terms, you enter into a legally binding agreement with FunderPro Ltd, a company registered under the laws of the Republic of Malta, registered with the Malta Business Registry under registration no. C 104558, with registered address at ST Business Centre Balluta, Level 4, 196, Triq Censu Tabone, St. Julian’s, Malta (the “Company”, “FunderPro”, “we”, “us” or “our”).
If you do not agree to these General Terms, do not create an account and do not use the Website or Dashboard.
1. Purpose and structure of the agreements
1.1 Scope. These General Terms apply to:
- registration and account creation;
- access to and use of the Website, Dashboard and general Content (defined below);
- general conduct, security, acceptable use, and communications;
- general compliance checks, integrity controls, and account restrictions; and
- other non-product-specific matters.
1.2 Separate product terms. The Company offers separate products and services that are governed by separate terms and conditions, including:
- FunderPro General Terms & Conditions for Challenges (the “Challenge Terms”); and
- FunderPro Instant Funding Terms and Conditions (the “Instant Account Terms”).
1.3 When product terms apply. If you purchase, access, or use a product in the Dashboard, you will be required to accept the applicable Challenge Terms or Instant Funding Terms at checkout. Those product terms govern that product and will prevail in case of conflict with these General Terms for product-specific matters including but not limited to fees, refunds, trading rules, performance/reward rules, evaluation/simulated funding processes.
1.4 No obligation to purchase. Creating an account under these General Terms does not oblige you to purchase any product.
2. Definitions
In these General Terms:
- “Account” means your registered user account for Website/Dashboard access.
- “Content” means all elements of the Website/Dashboard, including text, data, graphics, layouts, logos, trademarks, software, and other materials.
- “Services” means the general Website/Dashboard access and related support provided under these General Terms (excluding product-specific services governed by product terms).
- “Third-Party Providers” means third parties whose tools, platforms, payment systems, identity verification solutions, or other services may be integrated or linked.
- “You”, “your”, “Client”, or “User” means the individual (or legal entity where allowed) accessing or using the Website/Dashboard.
3. Eligibility, registration and account information
3.1 Age and capacity. You must be at least eighteen (18) years old and have full legal capacity to accept these General Terms and to use the Website/Dashboard.
3.2 Accurate information. You must provide complete, accurate, and up-to-date information when registering and when using the Dashboard. You must promptly update your details if they change.
3.3 No misrepresentation. You must not impersonate any person or entity, provide false information, or misrepresent your identity, residency, or location.
4. Compliance, restricted jurisdictions, and integrity controls
4.1 Legal compliance. You are solely responsible for ensuring that your access to and use of the Website/Dashboard complies with applicable laws and regulations in your jurisdiction.
4.2 Restricted access. The Company may restrict, suspend, or refuse access where (i) required by law, (ii) due to sanctions/AML/financial crime risk, (iii) due to residency in a restricted jurisdiction, or (iv) due to integrity or security concerns.
4.3 Location concealment prohibited. You must not use VPNs, proxies, anonymizers, spoofing tools, or similar methods to conceal or misrepresent location or identity or to bypass restrictions, pricing rules, or eligibility rules.
4.4 Checks and requests for information. We may conduct reasonable checks (including device/IP/location consistency and account integrity checks) and may request supporting information or documentation to protect our systems and ensure compliance.
5. Account security and credentials
5.1 Credentials. You are responsible for maintaining the confidentiality and security of your login credentials and any access methods used for the Dashboard.
5.2 No sharing. You must not share your credentials with any third party. If you are a legal entity and we permit authorised access, you remain responsible for all actions taken through your Account.
5.3 Your responsibility. You are responsible for all activity conducted through your Account. Notify us promptly if you suspect unauthorized access.
6. Website/Dashboard use and acceptable use
6.1 Permitted use. You may use the Website/Dashboard only for lawful purposes and only in accordance with these General Terms and any applicable product terms you have accepted.
6.2 Prohibited activities. You must not, and must not attempt to:
a) interfere with, disrupt, overload, or reverse engineer the Website/Dashboard or any systems or security measures;
b) exploit bugs, errors, vulnerabilities, or unintended features;
c) use automated scraping, bots, or data extraction tools except where expressly permitted in writing;
d) access areas or data you are not authorized to access;
e) upload, transmit, or distribute malware or harmful code;
f) engage in abusive, deceptive, or fraudulent conduct;
g) use the Website/Dashboard to violate third-party rights or applicable laws; or
h) circumvent technical or geographic restrictions.
6.3 Monitoring. We may monitor usage and activity on the Website/Dashboard for security, compliance, fraud prevention, and service improvement purposes.
7. Third-party services and links
7.1 Third-Party Providers. The Website/Dashboard may integrate or link to Third-Party Providers (including trading platform software providers, payment processors, and KYC/verification providers).
7.2 Third-party terms. Your use of Third-Party Providers is governed by their own terms and policies. We do not control Third-Party Providers and do not assume responsibility for them.
7.3 No endorsement. Links are provided for convenience and do not constitute endorsement.
8. Privacy and data protection
8.1 Privacy Notice. Personal data is processed in accordance with the Company’s Privacy Notice, which forms an integral reference point for these General Terms.
8.2 Communications. By creating an Account, you consent to receive transactional and service-related communications via email and/or the Dashboard.
9. Intellectual property and content
9.1 Ownership. The Website, Dashboard and all Content are owned by the Company or its licensors and are protected by intellectual property laws.
9.2 Limited licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website/Dashboard and Content for your personal internal use in accordance with these General Terms.
9.3 Restrictions. Except where expressly allowed, you must not copy, modify, distribute, sell, rent, licence, decompile, reverse engineer, create derivative works from, or otherwise exploit any part of the Website/Dashboard or Content.
9.4 Trademarks. Company names, logos and trademarks may not be used without prior written consent.
10. No investment services; no advice (general)
10.1 No regulated services. Nothing in these General Terms, the Website, or the Dashboard constitutes investment services, execution of orders, brokerage, portfolio management, or dealing on own account.
10.2 No advice. We do not provide investment, legal, tax, or financial advice. Any educational or informational material is for general purposes only.
11. Service availability; changes; maintenance
11.1 As-is access. The Website/Dashboard are provided on an “as is” and “as available” basis and may contain errors, interruptions, or delays.
11.2 Maintenance and changes. We may perform maintenance, upgrades, or modifications at any time, which may result in partial or complete unavailability.
11.3 No guarantee. We do not guarantee uninterrupted access or that the Website/Dashboard will be error-free.
12. Behaviour polic
12.1 Respectful conduct. Users must communicate respectfully with Company staff and must not engage in abusive, threatening, harassing, defamatory, or otherwise inappropriate behaviour.
12.2 Operational disruption. Excessive, unreasonable, or repetitive demands or communications that disrupt operations may result in restricted access.
12.3 Enforcement. We may restrict access, suspend or terminate Accounts, and refuse service where conduct negatively impacts staff well-being, Company reputation, operational integrity, or compliance requirements.
13. Suspension, restriction, and termination of account access
13.1 Your termination. You may request closure of your Account by contacting support (see clause 16). Account closure may limit access to prior records, subject to legal retention obligations.
13.2 Our rights. We may suspend, restrict, or terminate your Account or access to the Website/Dashboard immediately if:
a) you breach these General Terms;
b) we reasonably suspect fraud, identity misrepresentation, location concealment, or security compromise;
c) required for legal/compliance reasons (including sanctions/AML risk);
d) you attempt to circumvent restrictions or enforcement actions; or
e) you pose a security or operational risk.
13.3 Effect. Suspension/termination under these General Terms affects Website/Dashboard access. Product-specific effects including but not limited to fees, refunds, accounts, rewards are governed by the applicable product terms.
14. Disclaimers
14.1 No warranties. To the maximum extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, and non-infringement, in relation to the Website/Dashboard and Content.
14.2 Third-party systems. We are not responsible for issues caused by Third-Party Providers, including outages, errors, inaccuracies, or service interruptions.
15. Limitation of liability
15.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive losses or damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Platform.
15.2 Where liability cannot be excluded under applicable law, the Company’s total aggregate liability under or in connection with these General Terms shall be strictly limited to the fees actually paid by you to the Company for Platform access.
15.3 Nothing in these General Terms limits or excludes liability that cannot be limited or excluded under mandatory applicable law.
16. Communications and support
16.1 Official channels. Official communications will be provided via the Dashboard or email.
16.2 Support. You must contact our Support team at [email protected] for questions, complaints, or requests.
16.3 Language. Communications and these General Terms are in English. Any translations are for convenience only. In case of conflict, the English version prevails.
17. Changes to these General Terms
17.1 Updates. We may amend these General Terms from time to time. Material changes will be communicated in advance via the Dashboard and/or email.
17.2 Continued use. Continued use of the Website/Dashboard after the effective date of changes constitutes acceptance of the updated General Terms, unless applicable law requires a different mechanism.
18. Governing law and jurisdiction
18.1 Malta law. These General Terms are governed by the laws of Malta.
18.2 Jurisdiction. The courts of Malta shall have exclusive jurisdiction to resolve disputes arising out of or in connection with these General Terms, including non-contractual disputes or claims.
18.3 Consumer rights. This clause does not limit consumers’ rights under mandatory laws of their relevant EU Member State or other applicable jurisdiction.
19. Miscellaneous
19.1 Entire agreement. These General Terms govern the general Website/Dashboard relationship. Product purchases are governed by the applicable product terms accepted at checkout.
19.2 Assignment. We may assign our rights and obligations under these General Terms. You may not assign your rights or obligations without our prior written consent.
19.3 Severability. If any provision is invalid or unenforceable, the remaining provisions remain in full force.
19.4 No waiver. Failure or delay to enforce any right is not a waiver of that right.
